If you do not agree with any part of these Terms, you must immediately discontinue use of the Site. The Site is operated by mumflavors (“we”, “us”, or “our”), a provider of recipes, cooking tips, and related culinary content. These Terms constitute a legally binding agreement between you and mumflavors, and they govern your use of the Site, any services offered through the Site, and any content you submit or receive therein.
We reserve the right to modify these Terms at any time, for any reason, and without prior notice. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Site after such modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
Subject to your compliance with these Terms, mumflavors grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Site for personal, non‑commercial purposes. You may browse recipes, create a personal account, save favorite dishes, and share content on social media platforms, provided that you attribute the source appropriately and do not alter the original content in a misleading way.
You may not: (a) copy, reproduce, distribute, or publicly display any portion of the Site’s content except as expressly permitted herein; (b) sell, license, or otherwise exploit the Site’s content for commercial gain; (c) use any automated means (including bots, scrapers, or crawlers) to access, retrieve, or index the Site’s data; or (d) attempt to interfere with the security, integrity, or performance of the Site or its underlying infrastructure.
Violation of these usage rights may result in immediate termination of your access, removal of offending content, and any other remedies available under applicable law.
All original recipes, photographs, videos, articles, and other creative works posted on the Site (“Site Content”) are owned by mumflavors or its licensors. By default, Site Content is protected by copyright, trademark, and other intellectual property laws. We grant you a worldwide, royalty‑free, non‑exclusive license to view, download, and share Site Content for personal, non‑commercial use, provided you retain all original copyright notices and do not claim authorship.
If you submit any user‑generated content (UGC) to the Site—such as comments, reviews, or your own recipes—you retain ownership of your material, but you grant mumflavors a perpetual, irrevocable, royalty‑free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in any media now known or later developed. This license also allows us to sublicense your content to third parties for the purpose of promoting the Site.
You represent and warrant that any UGC you submit does not infringe the rights of any third party, is not defamatory, obscene, or otherwise unlawful, and that you have all necessary rights and permissions to grant the above license.
The Site and all Site Content are provided on an “as‑is” and “as‑available” basis. mumflavors makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, or suitability of the recipes, nutritional information, cooking instructions, or any other content. We do not guarantee that the Site will be uninterrupted, error‑free, or free of viruses or other harmful components.
All health‑related, dietary, or nutritional advice found on the Site is for general informational purposes only and should not be construed as medical or professional advice. You should consult a qualified health professional before making any changes to your diet, especially if you have allergies, medical conditions, or specific nutritional needs.
To the fullest extent permitted by law, mumflavors disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non‑infringement, and any warranties arising out of a course of dealing or usage of trade.
Under no circumstances shall mumflavors, its affiliates, directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. This includes, without limitation, loss of data, loss of revenue, loss of goodwill, or any other economic loss.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Site shall not exceed the amount you have actually paid to mumflavors, if any, in the twelve (12) months preceding the claim. If you have not made any payment to us, our liability shall be limited to a maximum of US$100.
The limitations set forth in this section apply regardless of the legal theory under which any claim is brought, including contract, tort (including negligence), strict liability, or any other theory.
Any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or any breach thereof shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, except that the parties may agree to a different arbitration provider in writing. The arbitration shall be conducted in English and shall take place in New York, New York, United States.
The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could grant, including injunctive relief and specific performance, and shall also be authorized to award damages, including reasonable attorneys’ fees and costs. The arbitration award shall be final and binding upon the parties, and judgment on the award may be entered in any court having jurisdiction.
Notwithstanding the foregoing, either party may seek provisional remedies (including temporary restraining orders or preliminary injunctions) in a court of competent jurisdiction to preserve the status quo pending arbitration. This provision shall not preclude either party from seeking relief in a small claims court for claims that qualify under applicable state law.
These Terms and any dispute arising out of or related thereto shall be governed by and construed in accordance with the substantive and procedural laws of the United States, without regard to its conflict‑of‑law principles.
